Undisputedly, 26 bighas, 16 biswas and 14 dhur land of Village - Hariav and Rajpura, Pargana, Tehsil & District – Bhadohi, was acquired by Notification dated 25.6.1988. The sale deed exemplar (paper No.39 Ga) relied by learned counsel for the claimant-appellant is in respect of a very small area of one biswa, 3 dhur. From perusal of the sale deed it is evident that the plot sold by the aforesaid sale deed was situated on Gyanpur Metaled Road. On the North side adjoining the plot was the house of one Ram Dular. Similarly, the other sale deed dated 1.6.1988 (paper No.41 Ga) was in respect of the small piece of land measuring 1 biswa 10 dhur which was also situated along the road. The acquisition in question was for a large area of 26 bighas, 16 biswa and 14 dhur. Therefore, the selling rate as reflected from the aforesaid two sale deeds exemplars of very small area can not be applied to determine compensation of the acquired land large area. That apart as per own showing of the claimant-appellants the plots sold by the aforesaid two sale deeds were situate on the road. Even if these two sale deeds exemplars are taken into consideration, the deduction for largeness of the area and development cost has to be made. Keeping in mind these two factors the determination of compensation by the reference court at Rs.20,000/- per biswa can not be said to be inadequate.
