Case called out in the revised list. No one appears on behalf of the revisionist to press this criminal revision. Learned A.G.A. representing the opposite party No. 1 is present.

The present criminal revision has been filed challenging the order dated 7.4.2001 passed by the Additional Chief Judicial Magistrate, Etah in Misc. Case No. Nil of 2001 (Bimlesh Vs. Atosh Kumar and others), whereby the application filed by the applicant for direction to police of Police Station Kotwali Dehat, District Etah to investigate the F.I.R. registered under section 498 I.P.C. and section 3/4 Dowry Prohibition Act, P.S. Kotwali Dehat, District Etah, has been rejected.

A perusal of the order passed by the Court below will go to show that Court below has recorded the finding that since the F.I.R. had already been registered at P.S. Kotwali Dehat, District Etah, no further direction directing the Investigating Officer, P.S. Kotwali Dehat, District Etah to investigate the matter is required, as the investigation of the case has been sent to police of District Farrukhabad by the order of the S.S.P. concerned. The reasoning recorded by the Court below for rejecting the application filed by the revisionist cannot be said to be illegal or perverse.

In view of the above, no occasion arises before this Court to entertain this criminal revision. It is, accordingly, dismissed.
