Heard Sri Jitendra Shanker Pandey, learned counsel for the petitioners, Sri Krishan Kumar Singh, learned counsel for the informant and the learned A.G.A.

The instant petition seeks quashing of the First Information Report dated 0022/2019, under Sections 363/366/498/506 IPC, P.S. Maniyar, Ballia.

Sri Singh, learned counsel for the informant has entered appearance on behalf of the informant / respondent no.4 and has also filed an affidavit indicating that respondent no.4 and petitioner no. 1 are living together peacefully as husband and wife and now she is no longer interested in prosecuting the impugned FIR.

If that be so, it is always open for the victim to apprise the I.O. concerned of the aforesaid who shall conclude the investigation to its logical conclusion as expeditiously as possible and submit a report before the court concerned.

In the event the I.O concerned does not extend necessary cooperation, it shall be open for the petitioner to approach the S.S.P / S.P concerned who shall be obliged to pass appropriate orders.

Till the submission of the police report under Section 173(2) Cr.P.C, no coercive action shall be taken against the petitioners.

With the above observations, the writ petition is disposed of.
