Heard Shri Ravi Prakash Singh, learned counsel for the appellant, Shri P.S. Mishra and Shri R.P. Pandey, learned A.G.A. for the State and perused the record.

At the very outset, learned counsel for the appellant has produced the order dated 26.09.2016 passed by another Bench of this Court in Criminal Appeal No. 653 of 2016 by which the matter of co-accused Param Singh was leniently viewed and quantum of sentence was reduced.

Learned counsel for the appellant has submitted that looking into the long period the accused-appellant is in jail, this Court may also take lenient view and the quantum of sentence of accused-appellant Zaqir may also be reduced.

Learned AGA has supported the finding of conviction and did not oppose the prayer for reduction of sentence.

Looking into the facts and circumstances of the case, considering the long incarceration of accused-appellant in jail and also the view taken by another Bench of this Court in the matter of co-accused Param Singh, this appeal is also finally disposed of on the same terms and conditions as has been ordered vide order dated 26.09.2016 by another Bench of this Court in Criminal Appeal No. 653 of 2016.
