The instant contempt application has been filed for alleged violation of the order of the Writ Court dated 8.8.2017.
On 8.8.2019, the following order was passed:-
"Shri Vishal Kakkar, learned Standing Counsel, seeks time to obtain fresh instructions from the respondent as regard compliance of the order of the writ Court. The instructions shall be obtained in light of submission advanced by learned counsel for the applicants that promotion which is to be granted to the applicants-petitioners in compliance of order of the writ Court is from the date persons junior to them were promoted consequently, the new Rules would not be an impediment.
List in the week commencing 02.09.2019.
The opposite party shall file his affidavit disclosing his stand in the matter."
An affidavit of compliance has been filed in pursuance of the above order. It is stated in the affidavit of compliance filed by the Director of Agriculture, U.P. Lucknow that in accordance with the direction of this Court in Writ Petition No.34218 of 2017, the applicant has been granted notional promotion from 17.8.2007, the date on which his immediate junior was granted promotion.
Counsel for the applicant admits that the direction issued by the Writ Court stands duly complied with.
As such, nothing remains to be decided in the instant contempt application. It is accordingly consigned to record.
