Heard Sri Deepak Kumar, learned counsel for the applicants, learned A.G.A. for the State and perused the material on record.

This bail application has been preferred by the accusedapplicants, who are involved in Case Crime No. 20 of 2019 under Sections 3(1) of U.P. Gangster Act and Anti Social Activities (Prevention) Act, 1986, Police Station Nahtaur, District Bijnor.

Learned counsel for the applicants submitted that only one case registered as Case Crime No. 481 of 2018 under Section 3/5/8 U.P. Cow Slaughter Act is shown against the applicants in the gang chart in which they have been bailed out by the court below, vide orders dated 31.1.2019. Further submission is that they are not involved in any criminal or any anti-social activity but have been implicated with false and concocted allegations. The applicants are in jail since 27.1.2019 and if they granted liberty, they will not misuse the same.

Learned A.G.A. has vehemently opposed the prayer for grant of bail.

Considering the facts and circumstances of the case, without expressing any opinion on the merits of the case, I find it a fit case for bail.

Let the applicants Akram and Munna involved in the aforesaid crime be released on bail on they furnishing a personal bond and two sureties each in the like amount to the satisfaction of the court concerned with the following conditions:-

The applicants shall not tamper with the prosecution evidence by intimidating/pressurizing the witnesses, during the investigation or trial.

They shall cooperate in the trial bonafidely without seeking adjournments.

¶13

They shall not indulge in any criminal activity or commission of any crime after being released on bail.

Conditions as asserted under Sections 19(4) (b) of the Gangster Act shall apply and in case of failure thereof, their bail shall be automatically deemed to be rejected.

In case of breach of any of the above conditions, it shall be a ground for cancellation of bail. Identity, status and residence proof of the applicants and sureties be verified by the court concerned before the bonds are accepted.
