Heard learned counsel for the applicant, learned A.G.A. and perused the record.

Learned counsel for the applicant contends that applicant is not named in FIR and has been falsely implicated; that as per averments made in FIR lodged on 6.11.2018 by one Rajendra Singh dead body of an unknown girl was found in fields of Tribhuwan, which was later on identified by her parents Harendra Chandra and Geeta Devi to be of their daughter Sapna; that parents of deceased in their statements under Section 161, Cr.P.C. have stated that deceased was having affair with Bikkan and was also having dispute with him and Bikkan appears to have caused her death; that applicant has been apprehended on the basis of call detail report regarding calls between applicant and co-accused Bikkan; that applicant is only driver of Bolero Jeep and carries passengers from Madanpur to Azamgarh and on fateful day Bikkan of his village along with a girl also travelled in his Bolero and was dropped by him near Village Raunapar; that applicant had no concern with deceased or Bikkan and had no motive to cause death of deceased Sapna; that applicant did neither cause any injury to deceased nor throttled her to death; that applicant has no criminal history; that applicant undertakes that he will not misuse the liberty of bail; that applicant is in custody since 26.11.2018.
