It has been contended by the learned counsel for the applicant that applicant has been falsely implicated in the present case and he has not committed the alleged offence. It is next contended that only one case has been shown against the applicant in the Gang Chart and in the said case, the applicant has been granted bail which has been properly explained in paragraph 8, of the affidavit filed in support of bail application. In other Nine cases in four cases applicant has been acquitted and in five cases he is on bail, which has been properly explained in Supplementary Affidavit filed today in this Case. It is also contended that co-accused persons namely Matendra Singh Yadav and Sharif have been granted bail by another Bench of this Court vide orders dated 12.10.2018 and 17.11.2018 passed in Crl. Misc. Bail Application No. 39782 and 43988 of 2018, copies of the said order has been produced before the Court it is taken on record. It is further contended that applicant is also entitled to bail on the ground of parity. Further submission is that there is also no possibility of applicant either fleeing away from the judicial process or tampering with the witnesses. Applicant who is in jail since 11.1.2019, undertakes that he will not misuse the liberty, if granted.
