Learned counsel for the applicant submits that the applicant is mother-in-law of the deceased. The applicant is an old lady aged about 66 years. At the time of alleged incident the applicant was living separate from the deceased and her husband at Mohalla Panch Nagari Sasnigate, Aligarh with her elder son namely, Manoj Kumar who is suffering from cancer disease. The deceased and her husband were living near old post office Jaiganj, Aligarh. As per first information report, the incident is said to be taken place in the night of 27.6.2019. In the post mortem report, cause of death of the deceased has been shown asphyxia due to strangulation and choking of mouth. The applicant has no concern with the alleged incident and has falsely been implicated in the present case. There is no direct evidence against the applicant. There is general allegation against the applicant. The applicant has not committed the alleged offence. The case of the applicant is distinguishable from the case of husband of the deceased who is in jail. There was no dispute of demand of dowry. The applicant is not beneficiary of the alleged demand of dowry. There is no criminal history of the applicant and is in jail since 29.6.2019.
