Learned counsel for the applicant submits that the applicant is father-in-law of the deceased. He has falsely been implicated in the present case. There was no dispute of demand of dowry. The applicant has not harassed or tortured the deceased. It has further been submitted that the FIR of the alleged incident was lodged against four persons including the applicant making general allegation. No specific role has been assigned to the applicant. As per postmortem report two injuries have been found on the body of the deceased and the cause of death of the deceased has been shown coma due to ante mortem head injury. The applicant has not caused any injury to the deceased. It has further been submitted that the deceased was insisting her husband to live separate from the applicant and his family members, it appears that some hot talk has taken place in between the husband and wife and in sudden provocation the husband to make a threat tried to cause a simple injury, but unfortunately the deceased died. There is no eye witness of the alleged incident. The applicant has not committed the alleged offence. The co-accused Radhey Shyam @ Radhey (jeth of the deceased) has already been released on bail by this court vide order dated 18.11.2019 in Cr. Misc. Bail Application No.50390 of 2019, therefore, applicant is also entitled for bail. The case of the applicant is distinguishable from the case of the husband of the deceased. There is no criminal history of the applicant and is in jail since 18.7.2019.
