It is argued by the learned counsel for the applicants that as per the allegation in the F.I.R., on 31.07.2019 at about 05:00 p.m., the informant's wife was going from Aligar to Etah by bus. On the way, few unknown person met her and made her smell something and took her from the bus to Sikandrau and from there to Kasganj. It is further argued that the applicant is not named in the F.I.R. He is innocent and has been falsely implicated in the present case. It is further argued that in the statement of victim under Section 161 Cr.P.C., she has supported the prosecution version as narrated in the F.I.R. However, in her statement recorded under Section 164 Cr.P.C, the story has been exaggerated but she has also accepted that the applicants have not done any wrong with her. The applicants have no criminal history except the present case and are languishing in jail since 03.08.2019. In case, they are released on bail, they will not misuse the liberty of bail and will cooperate in the trial by all means. Lastly, it is submitted that there is no chance of applicants fleeing away from judicial process or tampering with the witnesses.
