It has been argued by learned counsel for the applicant that as per version of the FIR the victim was enticed away by the named co-accused Rajan @ Rajesh Kumar, who is brother of the present applicant. It is submitted that co-accused Rajan was working as driver at the place of victim and has developed friendly relationship and they have solemnized marriage on 12.10.2018. In support of it he has annexed marriage certificate, which is Annexure 5 to the bail application, showing that both of them have solemnized marriage. Learned counsel has also drawn attention of the Court that the FIR was lodged on 11.10.2018 regarding commission of offence against the co-accused Rajan with the allegation that victim was enticed away by the co-accused Rajan and on 12.10.2018 they have solemnized marriage out of their own sweet will. As per medical certificate the victim is aged about 18 years. The applicant is innocent and being the friend of co-accused Rajan, he has been falsely implicated in the present case. Only allegation of made against the applicant in the statement of the victim recorded under Section 164 Cr.P.C. is of accompanying the co-accused Rajan in enticing away the victim. It is next argued that the coaccused Rajan @ Rajesh Kumar has already been enlarged on bail by this Bench vide order dated 5th March, 2019 passed in Criminal Misc. Bail Application No. 49182 of 2018. The case of the applicant is on better footing to that of the aforesaid co-accused. As such, the applicant is liable to be enlarged on bail.
