Learned counsel for the applicant submits that initially an N.C.R. was lodged by the deceased against the applicant and two unknown under section 323 and 504 I.P.C. on 23.2.2019. The injured deceased was medically examined on 23.2.2019. Four injuries have been found on his person. As per doctor's opinion, the injuries were simple in nature. The deceased died on 17.3.2019. Thereafter, the F.I.R. was lodged by the son of the deceased against the applicant and two unknown making general allegation for committing marpit with the deceased. Learned counsel for the applicant further submitted that the deceased was aged about 85 years and it transpires that the deceased died due to cardiac arrest. It has been further submitted that during investigation the name of Balram Yadav and Jalkesh Yadav @ Jagletar came into light and they have been enlarged on bail by another bench of this court vide order dated 18.10.2019 in Cr. Misc. Bail Application Nos. 33566 of 2019 and 38044 of 2019 respectively, therefore, applicant is also entitled for bail. It has further been submitted that there is general allegation against the applicant and other co -accused, no specific role has been assigned to the applicant. The applicant has not committed the alleged offence and has falsely been implicated in the present case. There is no criminal history of the applicant and is in jail since 27.3.2019.
