It has been contended by the learned counsel for the applicant that the applicant is innocent and has been falsely implicated in the present case due to ulterior motive and he has committed no offence. It is next contended that the applicant is a businessman and due-to old enmity with the police he has been falsely roped in the present case It is further contended that 29 kg. contraband article, i.e. "Ganja" is said to have been recovered from the joint possession of the applicant and other co-accused persns. He further submits that there is no compliance of mandatory provisions of Sections 42, 50, 52 & 57 of N.D.P.S. Act and there is also no compliance of sections 100 & 165 Cr.P.C., hence the recovery is bad in the eyes of law. Several other submissions in order to demonstrate the falsity of the allegations made against the applicant have also been placed forth before the court. The circumstances which, according to the counsel, led to the false implication of the accused has also been touched upon at length. It has been assured on behalf of the applicant that he is ready to cooperate with the process of law and shall faithfully make himself available before the court whenever required. It has also been submitted that the applicant is languishing in jail since 4.7.2018. The applicant has no other reported criminal antecedent. Co-accused Sanjai Kumar Jaiswal has already been released on bail by this Court on 7.12.2018 in Criminal Misc. Application No.46973 of 2918.
