Heard learned counsel for the applicant, learned A.G.A and gone through the record.

This bail application has been moved on behalf of accusedapplicant- Lilti Yadav, who is involved in case crime no. 48 of 2018 under Section 498A, 323, 307, 342 I.P.C. and Section 3/4 D.P. Act, Police Station- Sector-49 Noida, District- Gautam Buddh Nagar.

Submission of the learned counsel for the applicant is that he is innocent and has falsely been implicated in the case; that the marriage was solemnized before six years from the incident and there was no previous complaint in respect of illegal demand of dowry. It is lastly contended that the accused applicant is languishing in jail since 24.9.2018.

Sri Kumar Dhananjay, learned counsel for the complainant and learned A.G.A has opposed the prayer for bail. It is submitted by learned counsel for the complainant that the accused has brutely beaten the victim and thrown her in the forest; that the medical examination report shows fracture in the below back bone resulting the victim being completely bedridden.

During course of arguments learned A.G.A. has produced copy of case diary where in the statement of doctor Ravindra Kumar recorded under Section 161 Cr.P.C. reveals that said injury is grievous in nature and sufficient to cause death; that the accused applicant has criminal history under various Sections including Section 307 and 376 I.P.C.

The copy of case diary produced by learned A.G.A. is kept on record.

Considering the facts and circumstances of the case and gravity of offence, I do not find it a fit case for bail.

The bail application is, accordingly, rejected.
