It has been argued by the learned counsel for the applicants that applicants were not named in the initial information given to police regarding murder of deceased, which was recorded in G.D. entry. First information report of the alleged incident has been lodged after about 18-19 days and applicants were falsely implicated. Learned counsel further submitted that after investigation, police have not filed any charge sheet against applicants and during trial of the co-accused person, applicants and co-accused were summoned by the trial court under Section 313 Cr. P.C. It was further submitted that co-accused Suhel Akhtar, who was charge sheeted after investigation, has already been granted bail by coordinate Bench of this Court vide order dated 11.11.2016 in Criminal Misc. Bail Application No. 21740 of 2015. It was submitted that applicants are in judicial custody since 26.08.2018, having no criminal history. It was further submitted that in case applicants are released on bail, they will not misuse the liberty of bail and will cooperate in trial.
