Heard learned counsel for the applicant, learned A.G.A. for the State and perused the record.

Learned counsel for the applicant submits that in gang chart two cases have been shown against the applicant. One is under section 395, 397, 412 and 120B IPC in which the applicant is on bail and the another case is under section 3/25 Arms Act which is not covered under the purview of Gangster Act and on the basis of those cases the gangster act has been slapped upon the applicant. The applicant is in jail since 30.7.2019.

Per contra; learned A.G.A. has opposed the prayer for bail.

Considering the facts and circumstances of the case and without expressing any opinion on the merits of the case, I find it a fit case for bail.

Let the applicant Vakeel involved in Case Crime No. 389 of 2019, under sections 2/3 U.P. Gangsters and Anti Social Activities (Prevention) Act, P.S. Kotwali, District Bareilly be released on bail on his furnishing a personal bond with two sureties each in the like amount to the satisfaction of the court concerned with the following conditions:
