It is argued by learned counsel for the applicant that FIR has been lodged by the victim Monika alleging that her marriage was solemnized on 19.02.2019 with Ankit Kumar (brother of the applicant). After few days of her marriage when she came to know that her husband is impotent, her husband along with his family members started harassing her physically and mentally. She was also threatened for her life. On 03.03.2019 the younger brother of her husband, namely, Ankul Kumar (applicant herein) on promising to marry her established physical relationship with her. Therefore, the present FIR has been lodged. It is next argued that in her statement under Section 164 Cr.P.C. the victim has stated that earlier due to pressure of the family members, the applicant had promised to marry her, but later he refused to do the same. She has further stated that now the applicant is ready to marry with her. It is next contended that the parties are consenting. The applicant has no criminal history. There is no possibility of fleeing away from the judicial process or tampering with the witnesses and in case, the applicant is enlarged on bail, he shall not misuse the liberty of bail and he is languishing in jail since 24.07.2019. Accordingly, he requests for bail.
