Learned counsel for the applicant submits that the applicant is innocent and has been falsely implicated in this case. The real fact is that the wife of the co-accused Har Prasad namely, Kamlesh Devi had lodged a first information report under section 376/511, 452, 352, 323, 504, 506 and 354 I.P.C. against the husband of the opp. party no. 2 and one F.I.R. was also lodged by co-accused Har Prasad against the opp. party no. 2 victim, her husband and another under section 323, 324, 504 I.P.C. on 17.11.2018. In counterblast the opp. party no. 2 moved an application under section 156(3) Cr.P.C. on 3.4.2019 and on the basis of that application F.I.R. has been lodged against the applicant and co-accused Har Prasad on 26.4.2019. It has been further contended that false story has been concocted by the opp. party no. 2 and the injuries of injured opp. party no. 2 are simple in nature. The prosecution story is not probable and believable. The applicant has not committed the alleged offence and he has been falsely implicated in this case. The applicant is in jail since 15.7.2019.
