It has been argued by the learned counsel for the applicant that the first information report has been lodged by Akhilesh Mandal, Senior Depot Manager on 19th June, 2019 against unknown person alleging therein that on 17th June, 2019, it has been brought to the notice of the first informant that some petrol was stolen on the way from the vehicles carrying petrols of the department. It has also been brought to the notice of the first informant that the stolen petrol was sold. It has further been argued by the learned counsel for the applicant that the applicant is innocent and has been falsely implicated in the present case due to ulterior motive. the applicant has not been named in the first information report. During investigation, his name has surfaced. It has been alleged by the prosecution that on the basis of confessional statement of the applicant, alleged recovery of 100 to 150 litres of diesel have been shown from the house of the applicant. It is argued that the alleged recovery shown from the house of the applicant is planted one. The applicant has not given any confessional statement. Apart from the above, the confessional statement has no relevance. Except the confessional statement, there is no public or independent witness on the basis of which it can be said that the applicant is involved in the commission of the alleged offence.
