This is a bail application on behalf of the applicant Chandu in connection with Case Crime No.74 of 2019, under Sections 407, 411 I.P.C., P.S. Nai Ki Mandi, district Agra.

As per the allegation made in the first information report that the applicant was working in the workshop of the complainant and on 02.07.2019 the complainant had sent the applicant with chain of silver weighted about 30.5 Kg. to deliver the same to the shop of his customer but the applicant did not reach at the shop of his customer and ran away with the aforesaid chains of silver.

The submission of learned counsel for the applicant is that the applicant is quite innocent and has been falsely implicated in the present case with the ulterior motive. He submitted that the alleged recovery shown from the applicant is totally fake and false. He submitted that there is no public witness of the alleged recovery. He submitted that all the offences are triable by the court of Magistrate. He submitted that the applicant is languishing in jail since 03.07.2019 and in case, he is released on bail he will not misuse the liberty of bail and will cooperate in the trial.
