Heard learned counsel for the applicant and learned AGA for State and perused the materials on record.
The present bail application has been moved for enlarging the applicant on bail in Case Crime No. 171 of 2019, under Section 3/5A/8 of the Prevention of Cow Slaughter Act & 11 the Prevention of Cruelty to Animals Act, Police Station Saraimeer, District Azamgarh.
Learned counsel for the applicant submitted that applicant has been falsely implicated in the present case. It is further submitted that the applicant has not been arrested on the spot and nothing has been recovered form his possession; he is not involved in the alleged case of slaughtering cow, there is no criminal history of the accused-applicant and accused-applicant is languishing in Jail since 17.07.2019.
Per contra, learned AGA has opposed the prayer for grant of bail to the applicant and submitted that knife, chaper, sumi & theha have been alleged to be recovered on the spot, but he could not dispute the argument of the counsel for the applicant.
