It is argued by the learned counsel for the applicant that the applicant is quite innocent and has been falsely implicated in the present case with ulterior motive. He has further submitted that as per the allegations made in the F.I.R. the co-accusedRavindra Prasad is a fair price shop dealer and when his shop was inspected by District Supply Officer, excess amount of food grains was found. He further submitted that the applicant along with the co-accused owned a fair price shop and they used to carry a stock together for saving the fare. While the applicant had placed his stock in front of the shop of the coaccused, inspection was carried out due to which excess stock was shown by the inspection team. It is further submitted that the co-accused- Ravindra Prasad, who has already been granted bail by co-ordinate Bench of this Court vide order dated 11.09.2019 in Criminal Misc. Bail Application No. 33968 of 2019. The applicant is languishing in jail since 05.07.2019. The applicant has no criminal history except in the present case. In case, he is released on bail, he will not misuse the liberty of bail and will cooperate in the trial by all means. Lastly, it is submitted that there is no chance of applicant fleeing away from judicial process or tampering with the witnesses.
