It is argued by the learned counsel for the applicants that applicants are absolutely innocent and have been falsely implicated in the present case with some ulterior motive. It is further submitted that neither the applicants were apprehended on the spot, nor any incriminating articles were recovered from the possession of the applicants. It is next submitted that there is no independent witness of the alleged recovery and the applicants have no concern with the alleged recovery. It is next submitted that there is no chance of the applicants of fleeing away from the judicial process or tampering with the prosecution evidence. It is also submitted that co-accused, namely, Sukha @ Ateeq who was apprehended on the spot have already been granted bail by this Court vide order dated 23.07.2019 in Crl. Misc. Bail Application No,29493 of 2019 photo copy of the bail order has been produced during arguments before this Court, which is kept on record. The applicants have no criminal history and they are is languishing in jail since 01.07.2019. In case they are enlarged on bail they will not misuse the liberty of bail.
