Heard learned counsel for the applicant, learned A.G.A. for the State and perused the record.
Accused-applicant, involved in Case Crime No.126 of 2015, under Section 304 IPC, Police Station Manda, District Allahabad, applied for bail.
It has been contended by the learned counsel for the applicant that the applicant is innocent and has been falsely implicated in the present case. He further contended that there was a quarrel between one Digamber Omkar Giri and Digamber Pawanpuri over taking food and both sustained injuries, due to which Sant Pawanpuri has died during treatment. He further submitted that in this case trial is going on. In case, the applicant is released on bail, he shall not misuse the liberty of bail. The applicant is in Jail since 19.07.2015. He further submitted that a suitable direction be issued for expeditious trial.
Learned A.G.A. vehemently opposed the prayer for bail but he has no objection for expeditious trial.
Considering the submissions of learned counsel for parties, bail application is disposed of with a direction to Trial Court to conclude the trial within a period of six month from the date of production of a certified copy of this order, if, there is no legal impediment.
