It is argued by the learned counsel for the applicant that the applicant is innocent and has been falsely implicated in the present case due to ulterior motive. It is further argued that as per the allegation in the F.I.R., during search by the Police, the applicant was caught making illegal weapons at his residence. One 315 bore pauniya and eight country made pistol 315 bore and other things were shown to be recovered from the possession of the applicant, for which the present FIR has been lodged. It has been argued that there is no public witness to the aforesaid recovery and there is nothing on record to show that the applicant is involved in manufacturing or selling the illegal weapons. It is further argued that the applicant has criminal history of 03 cases except the present one and the same have satisfactorily been explained in paragraph-8 of the affidavit accompanying the present bail application. The applicant is languishing in jail since 01.01.2019. In case, he is released on bail, he will not misuse the liberty of bail and will cooperate in the trial by all means. Lastly, it is submitted that there is no chance of applicant fleeing away from judicial process or tampering with the witnesses.
