This is a bail application on behalf of the applicant Wazid in connection with Case Crime No.303 of 2019, under Sections 420, 406, 411 I.P.C. and 66 (C) I.T. Act, P.S. Nauchandi, District Meerut.

The submission of learned counsel for the applicant is that the applicant is quite innocent and has been falsely implicated in the present case with the ulterior motive. He submitted that the alleged recovery shown from the possession of the applicant is totally fake and false. He submitted that the applicant has not used his phone and has not received any illegal gain in his bank account. He submitted that his name has been nominated as a facilitator of the crime and co-accused, Akram who was assigned the similar role has been enlarged on bail by the learned lower court vide order dated 06.06.2019. He further submitted that all the offences are triable by the court of Magistrate. He claims parity. He submitted that all the offences are triable by the court of Magistrate. He submitted that the applicant is languishing in jail since 10.05.2019 and in case, he is released on bail he will not misuse the liberty of bail and will cooperate in the trial.
