This case is being taken up as per order of Hon'ble The Chief Justice vide order dated 17.1.2019.
Heard learned counsel for the applicant as well as learned AGA for the State and perused the record.
According to prosecution case, FIR was lodged against Bhola Yadav, Ravindra Yadav, Ramanand Yadav and Sunil Yadav alleging that on 18.7.2018 they assaulted Molai Yadav(father of first informant) with sticks(lathi-dandas). According to postmortem report, deceased received three injuries and died due to abdominal visceral injury.
It is submitted by learned counsel for the applicant that the applicant is languishing in jail since 20.7.2018(about six months) having no criminal history. He has been falsely implicated. General role is alleged to have been assigned to all the accused. It is not clear as to who has caused fatal injury to the deceased. Initially NCR was lodged under sections 323 and 506 IPC. Later on, after death of victim, section 302 IPC was added. There is no independent witness. In case applicant is released on bail, he will not misuse the liberty of bail and will cooperate in the trial.
