It is argued by the learned counsel for the applicant that the applicant is innocent and has been falsely implicated in the present case. As per version of the F.I.R., on 12.03.2019, when the son of the informant, Keshav Kumar was returning from the Vaishno Devi temple after worshipping, the accused persons came and started using abusive language and when objection was raised by the injured, the co-accused-Mahipal, father of the applicant, hit the injured on his head by wiper, due to which serious injuries has been sustained by the injured. The learned counsel for the applicant has drawn the attention of the Court to the compromise, which has been entered between the parties on 13.04.2019, copy of which has been appended as Annexure no. 7 to the affidavit accompanying the bail application. It is next submitted that the incident was a result of sudden quarrel as there were no enmity between the parties, hence he requests for bail. The applicant is languishing in jail since 15.04.2019. The applicant does not have any previous criminal history. In case, he is released on bail, he will not misuse the liberty of bail and will cooperate in the trial by all means. Lastly, it is submitted that there is no chance of applicant fleeing away from judicial process or tampering with the witnesses.
