Perused the report received from the District Judge, Mirzapur in compliance with the order dated 12.11.2018 passed by this Court in the present application. The learned Sessions Judge has said there that he called for a report from the sessions clerk, regarding S.T. No. 131 of 2018, State vs. Shamsher Bahadur, which indicates that the case has been committed to the Sessions on 13.08.2018 by the Chief Judicial Magistrate. He has further indicated that no certified copy of the order dated 09.01.2018 passed by this Court in Criminal Misc. Bail Application No. 975 of 2018, Shamsher Bahadur vs. State of U.P., was found annexed with the record. He has further recorded that on a perusal of the record he did not find any certified, or photostat copy of the order dated 09.01.2018 passed by this Court on record, filed before the Court on behalf of the complainant or accused, and it is also said, that it was not in the knowledge of the Court that an order has been passed by this Court to conclude the proceedings within six months.
