It is argued by the learned counsel for the applicant that the applicant is innocent and has been falsely implicated in the present case. The F.I.R. has been lodged against three persons with allegation that on 21.01.2019, when the informant was coming from his relative's place by motor cycle, it was by chance, the Scorpio car bearing no. HR 51 AF 6868 of the applicant hit the motorcycle of the informant and on objection raised by the informant, all the accused persons using abusive language, attacked on the injured persons by weapon and sticks, due to which the injured sustained injuries. Specific role of causing injury by fire arm weapon has been assigned to the applicant by which injuries has been sustained to the injuredPrem Prakash Rai. It is next submitted that as per the injury report of the injured-Prem Prakash Rai, lacerated wound (intery wound of fire arm) about 4 c.m. x 2 c.m. over Rt. side of chest 10 c.m. above from Rt. Nipple bleeding present, blacking at the margin, present margin invested depth conduct be measured. It is next submitted that it is a case of sudden quarrel, due to the accident and without any intention to kill, the applicant was assaulted the injured. The applicant is languishing in jail since 19.02.2019. The applicant does not have any previous criminal history. Lastly, it is submitted that there is no chance of applicant fleeing away from judicial process or tampering with the witnesses. In case, he is released on bail, he will not misuse the liberty of bail and will cooperate in the trial by all means.
