It has been argued by learned counsel for the applicant that for the alleged incident dated 4th December, 2018, the first information report has been lodged by Smt. Kusuma i.e. mother of the victim, namely, Sadhana on 10th December, 2018 i.e. after six days from the date of incident for which no plausible explanation has been given, which makes the prosecution case doubtful. In the first information report, it has been alleged that on 4th December, 2018 at 11:00 a.m., when the victim was going to jungle for taking woods for cooking food, then on the way, the victim was persuaded by the applicant to sit on his bicycle and getting a chance, he molested her. When the victim came to her house and narrated the whole story, the first informant went to the house of the applicant for making a complaint to the father of the applicant, he started abusing her. In the statement recorded under Section 161 Cr.P.C., the victim has reiterated the same version as unfolded in the first information report. However, in the statement recorded under Section 164 Cr.P.C., the victim has improved her version by stating that when she was going to jungle, on the way the applicant and his father took the victim forcefully on the bicycle near a tree and both of them molested her.
