Heard learned counsel for the applicant, Sri Mayank Mishra (B.H.), learned counsel appearing for the State and perused the record.
According to prosecution case, F.I.R. was lodged against five accused persons, namely, Manoj, Mohit, Satendra, Tara Singh and Smt. Sondevi alleging that Geeta and Reeta was married on 24.4.2014 with Manoj and Jitendra, respectively. For demand of ring, chain and rupees, they killed Geeta, wife of Manoj.
Learned counsel for the applicant submitted that applicant is father-in-law and is old person and languishing in jail since 27.12.2018 (about four months) having no criminal history. The applicant has been falsely implicated. He has no concern with the wife and husband. General role has been assigned against the applicant. She committed suicide herself after locking the door and Police personnel had broken the door. The applicant is not beneficiary of the articles. There is no independent witness/eye witness account against the applicant. In case he is released on bail, he will not misuse the liberty of bail and will cooperate in trial.
Learned A.G.A. opposed the prayer for bail but could not dispute the aforesaid fact as argued by learned counsel for the applicant and admitted that applicant has no criminal history.
