Learned counsel for the applicant has argued that the applicant is innocent and he has been falsely implicated in this very case crime number, whereas he was a valid Passport and Visa holder for his stay at India, though the period of the same had expired and owing to loss of the same extension of which could not be applied, but he being a valid Student Visa holder no. AB931866 issued on 20.10.2008, visited India on above Student Visa, where he joined English and Foreign Language University, Hyderabad, for a three month English Speaking Course and thereafter joined Jaya Arts Science College, Chennai, for B.Sc. Computer Science Course. Thereafter he joined S.R.M. University, Pothari, Chennai, for Computer Science Engineering Course. During this period he went to China and came back to India on many occasions. In the year 2011 he was residing in a rented House No. G3, Moongi Paradise Eswaran, 1st Koli Street, Urapakkam, Chennai, and started job of Translator of Chinese language. In the year 2017 the applicant lost his Passport but could not lodge any complaint in this regard. Co-accused Syed Imran Naseer managed for PAN Card and Adhar Card and opened an account in IDBI Bank in the name of Steven Jana. Coaccused did his M.B.B.S. from China and due to good command on Chinese language, became a friend of the applicant. With the help of co-accused these documents were got prepared and he was helping the applicant from crossing the border from India to Nepal. The accused-applicant is of no criminal antecedent. His mother is a teacher in a private school in China, who has filed her own affidavit reiterating all the facts stated in the previous affidavit filed in support of bail application. Her Passport and Visa have been validly extended, photocopies of the same have been annexed with the supplementary affidavit. Accused-applicant is ready to make compliance of the conditions imposed by this Court. He will not leave the jurisdiction of Sessions Court, Maharajganj, during trial of above case and he will apply for valid Passport and Visa at appropriate office. He will not misuse liberty of bail. Hence bail has been prayed for during trial.
