Heard learned counsel for the applicant and learned A.G.A. for the State.

By means of this application, the applicant who is involved in Case Crime No. 1000 of 2018, under Sections 406, 420, 409, 120-B I.P.C., P.S. Baradari, District Bareilly and is in jail since 27.07.2018, is seeking enlarged on bail during trial.

First information report reveals that it was got lodged on 27.07.2018 upon report of Sandeep Maurya against 15 persons, who are said to be Directors and Corporators of Sri Ganga Infra City Private Ltd company, in which informant and other victims have invested their money, but it was subsequently found to be a forged company, which had usurped all those deposits. The applicant is not an agent of the company nor the worker of the company.

Learned counsel for the applicant submitted that the applicant himself is the victim of cheating and fraud committed by the main accused persons Rajesh Maurya and his family members. It is submitted by learned counsel for the applicant that similarly place co-accused Sandeep @ Chandeep Singh, Smt. Sanjoli have already been enlarged on bail by another Bench of this Court vide orders dated 30.04.2019 and 14.05.2019 passed in Criminal Misc. Bail Application No. 18050 of 2019 and 20172 of 2019. He further submitted that the applicant is having no criminal antecedents and is languishing in jail since 27.07.2018. He further submitted that since the role of the applicant is identical to that of co-accused Sandeep @ Chandeep Singh, who has already been enlarged on bail, he is also entitled to be enlarged on bail on the ground of parity.

Learned A.G.A. has opposed the bail plea. He does not dispute the factum of parity.

Considering the submissions made by learned counsel for the applicant as well as learned A.G.A., this Court is of the view

that the applicant has made out a case for grant of bail on the ground of parity.

Accordingly, the bail application stands allowed .

In view of the above, let the applicant, Ram Kishore Maurya be released on bail in the aforesaid case crime number on his furnishing a personal bond and two reliable sureties each of the like amount to the satisfaction of the court concerned subject to the following conditions:-

i) The applicant shall not tamper with the prosecution evidence.

¶15

ii) The applicant shall not threaten or harass the prosecution witnesses.

¶16

iii) The applicant shall appear on the date fixed by the trial court.

¶17

iv) The applicant shall not commit an offence similar to the offence of which the applicant is accused, or suspected of the commission.

¶18

v) The applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade such person from disclosing facts to the Court or to any police officer or tamper with the evidence.
