Heard learned counsel for the applicants, learned A.G.A. for the State and perused the material on record.
This application under Section 482, Cr.P.C. has been filed for staying the further proceeding of case no.496M/2002, Ganga Devi vs. Kashi Ram and Others, u/s 452/376/506 IPC, P.S. Jahanabad, district Pilibhit and proceeding of case no.330/2004, State vs. Kashi Ram and Others, pending in the court of IIIrdAdditional Chief Judicial Magistrate, Pilibhit.
The contention of learned counsel for the applicants is that no offence against the applicants is disclosed and the present prosecution has been instituted with a malafide intention for the purposes of harassment.
From the perusal of the material on record it transpires that learned trial court has passed the order dated 20.4.2005 not in accordance with the findings of the learned revisional court's order dated 17.62.2004. So, it is directed to the learned trial court to pass an appropriate order in accordance with law after hearing both the parties.
With the aforesaid direction, this application is finally disposed of.
