Heard Sri Sanjay Shukla, learned counsel for the applicant and Sri Azad Singh, learned A.G.A. for the State.

Present application has been filed for quashing the recovery warrant dated 26.10.2018 which is issued in Criminal Case No. 354 of 2017 and direct the court below till the disposal of application under section 126 Cr.P.C. dated 23.10.2019 (P.S. Sitwa, District Siddharth Nagar) which is registered as Case No. 916/2019 and both the cases pending in the court of Principal Judge, Family Court, Siddharth Nagar and further staying the proceeding in Case No. 354/2017, under section 128 Cr.P.C., P.S. Sitwa, District Siddharth Nagar during the pendency of the present application.

After hearing the learned counsel for the applicant, learned A.G.A. and after perusing the material on record, no useful purpose would be served in keeping the petition pending which is finally disposed off with a direction to the Principal Judge Family Court, Siddharth Nagar to consider and conclude the recall application dated 23.10.2019 registered as Case No. 916/2019, most expeditiously, strictly in accordance with law, after hearing the parties and without granting any unnecessary adjournment to either the parties, preferably within a period of one month from the date of production of a certified copy of this order before him.

Till the disposal of the recall application dated 23.10.2019, under section 126(2) Cr.P.C. filed by the applicant, recovery warrant shall be kept in abeyance.
