Heard learned counsel for the applicant, learned AGA for the State and perused the record.
The present application u/s 482 Cr.P.C. has been filed with a prayer to direct the court below to decide his bail application when the applicant appears and surrenders before the court below in Case Crime No.55 of 2016, under Sections 147, 148, 325, 504, 506, 308, 323 and 336 IPC, Police Station Kothibhar, District Maharajganj, as expeditiously as possible on the same day.
As per the allegations made in the FIR, it is alleged that the applicant had assaulted the victim by Lathi-Danda due to which the victim suffered injury on his head and has been medically examined.
From the allegations made in the FIR, prima facie offenc is clearly disclosed against the applicant.
In view of the above, it is directed that if the applicant appears/surrenders before the court below and applies for bail, his prayer for bail shall be considered and decided as expeditiously as possible without giving unnecessary adjournments.
With the aforesaid observations, this application under Section 482 CrPC is finally disposed of.
