Heard Shri Ram Sheel Sharma, learned counsel for the applicants, learned A.G.A. for the State and Shri Ajendra Kumar, Advocate on behalf of complainant- O.P. No. 2.

The present application under Section 482 Cr.P.C. has been filed for quashing order dated 01.11.2017 passed by Additional Civil Judge (Senior Division) IInd Jaunpur in Complaint Case No.2847/2015, Sharifunnisha Vs. Saleem Shaikh alias Babloo and others, under Sections 498-A, 323, 504, 506, IPC and 3/4 D.P. Act, P.S. Kerakat, District Jaunpur, whereby Non Bailable Warrants were issued to the applicants. Earlier this Court vide order dated 26.10.2018 referred the matter to the mediation centre and as per report of the mediation centre, mediation completed but no agreement has been arrived between the parties.

The prayer for quashing Non-Bailable Warrants is refused. However, considering the facts and circumstances of the present case, the applicants are directed to appear before the concerned court along with an application for recalling the order dated 01.11.2017 issuing Non-Bailable Warrants and in case the applicants appear and file the application within three weeks, then the said application be decided by the learned magistrate in accordance with law.

For a period of three weeks from today no coercive action shall be taken against the applicants. In case the applicants failed to appear within the aforesaid time before the concerned magistrate, coercive action shall be taken against the applicants in accordance with law.

With the aforesaid direction, the application stands disposed of.
