Heard learned counsel for the applicant and learned A.G.A for the State.

The applicant is the informant in Sessions Trial No. 163 of 2016 in case crime no. 148 of 2016 under Sections 147, 148, 149, 302, 504 IPC P.S. Prem Nagar, District Jhansi pending before Additional Sessions Judge, Court No. 5, Jhansi.

The applicant has earlier approached this Court by way of application under Section 482 No. 2880 of 2019 which was disposed of directing the trial court to speed up the matter and conclude the trial strictly in accordance with provisions of Section 309 Cr.P.C.

The submission is that despite the aforesaid order dated 24.1.2019 trial has not been concluded. It has been further submitted that statement only P.W. 1 has been recorded till date.

Since this is the second application praying for the same relief it cannot be entertained, however, it is observed that the applicant shall point out to the court below the order dated 24.1.2019 passed in application under Section 482 No. 2880 of 2019 and it is expected that the trial court shall get the witness examined at the earliest and conclude the trial within a period of one year.
