The present 482 Cr.P.C. application has been filed to set aside the order dated 7.9.2017 passed by Additional Chief Judicial Magistrate-III, Gautambudh Nagar in Complaint Case No. 68 of 2014 (Karamveer Vs. Tej Singh and others) under Section 307/34 IPC, P.S. Greator Noida, District Gautambudh Nagar pending in the court of Additional Chief Judicial Magistrate-III, Gautambudh Nagar as well as as further proceeding of aforesaid complaint case in pursuance to the impugned summoning order.

Learned counsel for the applicants submits that he has been falsely implicated by the police under the alleged sections.

In that view of the matter, they are permitted to move discharge application through counsel before the trial Court within one month from today and the trial court shall decide the same within a period of two months from the date of filing of application alongwith certified copy of this order.

Till the discharge application is decided, no coercive measures shall be taken against the applicants.

With the aforesaid observations, this application is disposed of.
