Heard learned counsel on behalf of applicants and Sri Sanjay Singh, learned AGA-I for the State.

This application under Section 482 Cr.P.C. has been filed to quash the entire proceedings of Case No. 465 of 2011 (State Vs. Harish Chandra & others), under sections 363, 366 IPC in Case Crime No. 10 of 2011, P.S. Chaubepur, District Rama Bai Nagar, pending in the court of learned Additional Chief Judicial Magistrate, I, Ramabai Nagar.

It is contended by learned counsel on behalf of applicants that applicant nos. 1 (Smt. Pushplata) and 2(Ajay @ Bablu) solemnized their marriage on 05.10.2010 and from their wedlock two children have been born and both, the applicant nos. 1 and 2, are living together. A copy of marriage certificate and certificate of Marriage Registration dated 12.10.2010 have been annexed as Annexure No. 2 to the affidavit filed in support of this 482 application.

Perused the counter affidavit filed on behalf of State.

Considering the facts and circumstances of the case, as noted herein above, and also the submissions made by the counsel for the parties, the court is of the considered opinion that no useful purpose shall be served by prolonging the proceedings of the above mentioned case.

Accordingly, the proceedings of the aforesaid Case are hereby, quashed.

The application is, accordingly, allowed. There shall be no order as to costs.
