Heard learned counsel for the applicant, learned A.G.A. for the State of U.P. and perused the record.
This application under Section 482 of the Code of Criminal Procedure (in short 'Code') has been filed on behalf of the applicants with a prayer to quash the entire proceedings of Complaint Case No.415 of 2015, (Smt. Shweta Chaudhary Vs. Harendra Singh Rana and others), under Sections 406 I.P.C., Police Station -New Agra, District -Agra, pending in the court of Special Chief Judicial Magistrate, Agra on the ground that the parties have settled their dispute.
Learned counsel for both the parties contended that matter has been settled between the parties through compromise. In this reference joint affidavit has been field by the applicant and opposite party no.2.
This is a case of matrimonial dispute, which has been amicably settled between the parties.
As per judgment of Hon'ble Apex Court in the case of Social Action Forum for Manav Adhikar and another Vs. Union of India reported in 2018 SCC OnLine SC 1501 , the proceedings of aforesaid case is quashed.
Accordingly, the instant application stands allowed .
