Heard Sri Anil Kumar, learned counsel for the applicant, Sri Sanjay Kumar Shukla, Advocate on behalf of opposite party no. 2 and learned A.G.A. for the State.

The present application under Section 482 Cr.P.C. has been filed to quash the charge sheet dated 30.09.2016 as well as entire proceeding of Case No. 4989 of 2017(State Vs. Ravi Mehar and others), arising out of Crime No. 6/15, under Sections 498A, 323, 504, 506 of IPC & 3/4 of Dowry Prohibition Act, Police Station Mahila Thana, District Gorakhpur.

It is submitted by the learned counsel for the applicant that the matter has been compromised between the parties. Certified copy of the compromise application has been appended as Annexure No. 3 to the affidavit filed in support of 482 application.

From the compromise, it is apparent that the matter was settled for alimony of Rs. 17 lacs, out of which 13 lacs was paid and 4 lacs was agreed to be paid after the order passed in the proceeding under Section 13-B of Hindu Marriage Act for mutual divorce. It is further stated in the application filed under Section 13-B of Hindu Marriage Act that opposite party no. 2 has no objection in case the present proceeding is quashed. In this regard, the counter affidavit had already been filed by opposite party no. 2.

In view of the above, the entire proceeding of Case No. 4989 of 2017 is hereby quashed.

This application stands allowed.
