This application has been preferred for quashing of entire proceedings of complaint case No. 2303 of 2004 under Section 138 N.I. Act pending in the Court of Special Chief Judicial Magistrate, Varanasi.
Earlier on 7.10.2005 stay has been granted but on nonprosecution stay order has been vacated on 11.5.2007. Even thereafter non- appearance on behalf of the applicant shows that applicant is least interested in the proceedings of the case.
In view of the above, the application is rejected for want of prosecution.
