Heard learned counsel for the applicants and learned A.G.A. for the State and perused the material brought on record.
By way of the instant applicants, the applicants have sought for quashment of the charge sheet no.152 of 2018, dated 23.08.2018, cognizance order dated 17.09.2018 and entire proceeding in Case No.2109 of 2018, State Vs. Banney Shah and others, under Sections 4/11 Mines and Minerals (Regulation of Development) Act, 1957, Sections 379, 411 I.P.C., Police Station Ajim Nagar, District Rampur pending in the court of the Judicial Magistrate, Rampur.
At the very outset, learned counsel for the applicants has submitted that the applicants wish to move bail application before the trial court and relinquish the prayer for quashment.
Learned A.G.A. has no objection.
However, taking into consideration the facts and circumstances of the case, it is provided that in case the applicants appear before the court concerned within 15 days from today and move application for bail, the same shall be considered and disposed of by the court below, if convenient, on the same day.
For a period of 15 days from today, no coercive action shall be taken against the applicants.
It is made clear that in the event no such application is moved within the time prescribed above, this order will be of no avail to the applicants.
With the above direction, the instant application under Section 482 Cr.P.C. is finally disposed of.
