Heard Ms. Tanisha Jahangir Monir, learned counsel for the applicants, Sri Sanjay Singh, learned AGA-Ist, for the State.

The present application under section 482 Cr.P.C. has been preferred with a prayer to quash the impugned charge sheet dated 19.4.2007 giving rise to Criminal Case No. 1095 of 2007, under sections 323/504/506 IPC, read with Section 3 (1) X SC/ST Act, Police Station - Kotwali Handia, DistrictAllahabad (State v. Brij Karan Singh and others) pending before the court of Special Judge (SC/ST Act), Allahabad.

During course of argument learned counsel for the applicants confined her prayer to the extent that the concerned court below be directed to decide the aforesaid Criminal Case pending before it within a stipulated period of time to be fixed by this Court.

Considering the submissions of learned counsel for the applicants, facts and circumstances of the case and perusal of material available on record, no useful purpose would be served in keeping the application pending which is finally disposed off , with a direction to the concerned court below to consider and conclude the aforesaid Criminal Case No. 1095 of 2007, under sections 323/504/506 IPC, read with Section 3 (1) X SC/ST Act, Police Station - Kotwali Handia, District- Allahabad (State v. Brij Karan Singh and others), pending before the court of Special Judge (SC/ST Act), Allahabad, expeditiously, if already not decided, strictly in accordance with law, after hearing the parties and without granting any unnecessary adjournment to either of the parties, preferably within a period of six months from the date of production of a certified copy of this order, provided the proceeding are not stayed by any court of law.

Till the disposal of the aforesaid Criminal Case no coercive measure shall be taken against the applicants subject to cooperation of the applicants in the disposal of the aforesaid case.
