Heard Sri Deependra Yadav, learned counsel for the applicant, learned A.G.A. for the State and perused the record.

The present 482 Cr.P.C. application has been filed for a suitable direction to the A.C.J.M.-3 Gorakhpur to decide and dispose the Complaint Case No.2526 of 2017 (Kalpana Gupta vs. Smt. Kamla Chand) under Section 138 N.I. Act, Police StationRajghat, District Gorakhpur, pending in the court of learned A.C.J.M.-3 Gorakhpur, within stipulated period.

No useful purpose would be served in keeping the petition pending, which is finally disposed of with a direction to the A.C.J.M.-3 Gorakhpur to consider and decide the Complaint Case No.2526 of 2017 (Kalpana Gupta vs. Smt. Kamla Chand) under Section 138 N.I. Act, Police Station-Rajghat, District Gorakhpur, pending in the court of learned A.C.J.M.-3 Gorakhpur, most expeditiously, preferably within a period of six months from the date of production of certified copy of this order, before concerned court below, in accordance with law, after hearing the concerned parties, without granting unnecessary adjournment to either of the party, in case the proceedings of the aforesaid case, is not stayed by any Court.

With the aforesaid observation/ direction, the application under Section 482 Cr.P.C. is finally disposed of.
