Heard learned counsel for the petitioner and the learned AGA for the State.
The present petitioner u/s 227 of the Constitution of India has been filed with a prayer to direct the learned Judicial Magistrate, Court No. 14, Azamgarh to decide Case No. 68 of 2019 (Sumitra Devi Vs. Ramesh and others), Execution Case No. 156/17/C.U. 19 of 2016, P.S. Kotwali, District- Azamgarh expeditiously within stipulated period.
Learned counsel for the petitioner has submitted that the present proceeding has been pending since 2016 and has been lingering-on, on one pretext or the other.
In view of the above, the Judicial Magistrate, Court No. 14, Azamgarh is expected to make all endeavours to decide the aforesaid case expeditiously, preferably within a period of two months from the date of filing of certified copy of this order after giving opportunity of hearing to both the parties without giving any unnecessary adjournments to either parties and there is no other legal impediment in deciding the aforesaid case.
With the aforesaid observations, the petition is finally disposed of.
