The prayer made in the instant petition is for issuing direction to the Additional Principal Judge, Family Court, Court No.5, Kanpur Nagar to decide Case No.1100 of 2018 under Section 13 of the Hindu Marriage Act, 1955 within six months as prescribed in Section 21-B of the Act.
Counsel for the petitioner submitted that the opposite party has already entered appearance in the proceedings and also filed an application under Section 24 of the Act, but thereafter did not appear in the Court to press the same, resulting in its dismissal for non prosecution.
As admitted by the petitioner himself, Section 21-B itself provides a time frame within which the matter is to be decided, therefore, no further direction is required to be issued in the instant matter.
The petition stands disposed of accordingly.
